1. Disclaimer of Liability

The Company takes all necessary measures to provide users with a secure environment, as well as valid, reliable and up-to-date information. Nevertheless, each user remains responsible for assessing the accuracy of the posted content, regardless of whether such information is provided by the Company itself or by third parties.

The Company makes reasonable efforts to maintain the Website and keep it available, and reserves the right to modify and/or temporarily or permanently discontinue all or part of it, with or without notice to users, given that availability may be affected by users’ hardware and software, by other communications networks, by a large number of persons attempting to access it simultaneously, or by other causes. Consequently, the Company bears no liability for any damage arising from users’ inability to access the Website, from the suspension of all or part of it, from delay, non-delivery, interruption or poor quality of reception of its services, from the loss of its content, or from the existence of errors of any kind. The user acknowledges that communications over open networks are exposed to numerous threats that render them insecure, and that it is incumbent upon the user to take all necessary technical measures to adequately control them — including, among others, maintaining up-to-date malware detection systems (viruses, trojans, etc.) as well as up-to-date security patches for the respective browsers.

Accordingly, the Company assumes no undertaking and bears no liability whatsoever for any risk or damage (direct or consequential) that the user may sustain from the use of the Website and its content.

The Company reserves the right to remove the relevant links from the Website at any time, at its discretion.

3. Intellectual – Industrial Property – Prohibition of Republication

The entire content of the Website, including but not limited to information, services, distinctive titles, trademarks, images, graphics, photographs, designs, texts, product descriptions and technical specifications, etc., constitutes the intellectual and industrial property of the Company and is protected by the Greek and EU regulatory framework on intellectual and industrial property, as well as by the relevant international conventions. Likewise, the corporate name, images, graphic design (look & feel), underlying programs (including source code), logos and distinctive features contained in the Website constitute assets of the Company and are protected by the relevant trademark legislation.

It is noted that certain trademarks, product names and logos of scanner or software manufacturers that may appear on the Website belong to their respective rights holders and are used solely for the purpose of describing and promoting the products and services offered.

In any event, the display and presentation of the above content on the Website shall in no way be construed as a transfer or grant of a licence or right to use it. Any copying, digital recording, mechanical reproduction, transfer, downloading, resale or creation of derivative work based on such content is prohibited, as is misleading the public as to the actual provider/operator of the Website. The reproduction, republication, uploading, announcement, dissemination, transmission or any other use of the content, in any manner or medium, for commercial or other purposes, is permitted only with the prior written consent of the Company or of any other lawful holder of the relevant rights.

4. Products, Services, Orders and Prices

Through the Website’s online store, the Company offers for sale digitization equipment (book and document scanners, accessories, software) and presents the digitization, OCR and e-book creation services it provides.

The Company makes every possible effort to ensure that product information, photographs, technical specifications and prices are accurate and up to date. However, it is not liable for any technical or typographical errors made inadvertently or due to interruptions in the operation of the Website. Product images are indicative.

Product prices are stated in euro (€) and, unless otherwise specified, include the applicable VAT. The Company reserves the right to change prices at any time without prior notice; the applicable price is the one displayed at the time the order is completed. Any shipping costs are calculated and displayed separately before the order is finalised.

The submission of an order by the user constitutes an offer to conclude a contract of sale. The contract is deemed concluded upon the Company sending a relevant confirmation of acceptance of the order. The Company reserves the right not to accept or to cancel an order in the event of product unavailability, incorrect price listing or inability to verify the customer’s identity, notifying the user accordingly and refunding any amount paid.

5. Payment Methods

Orders are settled using the payment methods described on the Website during the checkout process (indicatively: debit/credit card through the secure environment of a partner payment service provider, bank deposit/transfer, etc.). Card transactions are processed through a certified payment service provider in a secure encrypted environment; the Company does not store card details.

6. Shipping and Delivery

Products are shipped via partner courier/transport companies, within the timeframes stated on the Website or agreed with the customer. The stated delivery times are indicative and may vary due to availability, the particular characteristics of the equipment, or reasons of force majeure. The risk of accidental destruction or deterioration of the product passes to the customer upon delivery. Upon receipt, the customer must check the integrity of the packaging and of the product.

7. Right of Withdrawal and Returns

A customer who is a consumer has the right to withdraw from the distance contract without stating any reason within fourteen (14) calendar days from receipt of the product, in accordance with Law 2251/1994 and Directive 2011/83/EU, as in force. To exercise this right, it suffices to send a clear statement to that effect to the Company (e.g. to info@bookscanner.gr) before the expiry of the above deadline.

In the event of withdrawal, the product is returned in the condition in which it was received, complete and undamaged, together with all its accessories and packaging. The Company refunds the price within the statutory deadline, while return costs are borne by the customer, unless otherwise specified. The right of withdrawal does not apply to the exceptions provided for by law (indicatively, to products manufactured or configured according to the customer’s specifications or clearly personalised, as well as to services that have been fully performed with the customer’s express consent).

Irrespective of the right of withdrawal, the provisions on the statutory guarantee and the seller’s liability for material defects and lack of agreed qualities apply.

8. Warranty

Products are accompanied by the respective manufacturer’s warranty of proper operation, as described in the accompanying documentation, as well as by the statutory guarantee provided for under applicable consumer protection legislation. The terms, duration and coverage of each warranty depend on the manufacturer and the specific product.
